General Terms and Conditions


Scope of application

Business transactions and deliveries are carried out exclusively in accordance with these General Terms and Conditions, based on the offers on the online store page of the MINT LAMA brand - www.mintlama.ch. The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise agreed.

A consumer (customer) is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their independent professional or commercial activity.

The following terms and conditions shall also apply exclusively if MINT LAMA GmbH (seller) carries out the delivery and service without reservation in the knowledge of conflicting or deviating terms and conditions. MINT LAMA GmbH also reserves the right to refuse orders without giving reasons.

Product range

All information on the goods that the customer receives during the ordering process is non-binding. We reserve the right to make changes to the design and technology that do not change or improve the functionality of the products, as well as to erroneous descriptions, illustrations and prices. Information on promotions is only valid while stocks last.

How to order

All orders at mintlama.ch require customer registration. When entering the personal data required for registration, the customer is responsible for providing truthful and complete information. Confirmation of registration is sent by e-mail immediately after the registration has been sent. The customer must ensure that the e-mail address provided by him for order processing is correct so that the e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller can be delivered.

The customer can submit the offer via the online order form integrated in the seller's online store. After entering their personal data and clicking on the button to complete the order process, the customer submits a legally binding contractual offer in relation to the goods contained in the shopping cart. If the bindingly purchased goods are no longer desired, the seller may charge the customer a fee for the handling.

Terms of delivery

The products ordered can only be delivered to an address in Switzerland or Liechtenstein. If stocks permit, the products will be delivered to the delivery address specified by the customer immediately after receipt of payment. The customer will receive an automated order confirmation by e-mail after receipt of payment. If the product is not in stock, the customer will be informed by e-mail. The liability of MINT LAMA GmbH ends with the acceptance of the goods from the carrier. MINT LAMA GmbH will cover the shipping costs from CHF 45.00. Delivery times are the working days stated in the article. MINT LAMA GmbH reserves the right to charge for delays caused by the carrier.

Parcel deliveries are made with DHL. If DHL does not reach anyone on the first delivery attempt, a new attempt will be made the following day. If this is also unsuccessful, your delivery notice will be left in the letterbox. The customer must respond within 10 days. If the parcel is returned to us due to a failure to respond to the delivery invitation in good time, the cost of redelivery will be passed on to the customer.

If a product is no longer available after receipt of the order, the customer will be informed and the item will be canceled from the order. If the customer wishes to purchase an alternative item, a new order must be placed or the existing order adjusted. If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment.

Right of return / exchange of goods

MINT LAMA GmbH grants the customer a right of return within a period of 7 days from receipt of the goods if the size of the article does not fit. The goods must be checked immediately upon receipt. Complaints or returns can only be considered within the 7-day period.

If the goods are dispatched and the buyer returns the delivery, an administration fee of 10% of the order value will be charged, which will be deducted directly from the credit note. This fee does not apply if there is an exchange due to the size of the product. In the case of refunds, the payment fees incurred are to be borne by the buyer. The right of return is excluded for sold-out items (only while stocks last, sale/discounted products, etc.) and for pre-order items that are produced specifically for an end customer.

Returns

In the event of a return, the customer service of MINT LAMA GmbH must be contacted in advance. The prerequisite for exercising the right of return is that the returned goods are returned in the original packaging in an undamaged, unused, clean, functional and complete condition. The same regulations apply to the exchange of goods. The customer shall bear the costs of returning the goods. The address for returning the goods may vary depending on the item that needs to be returned. You will receive this information when you contact MINT LAMA GmbH. Returns that are not registered in advance and confirmed by MINT LAMA GmbH will generate additional costs that will be charged by our external warehouse partners. These costs must be borne by the buyer.

Incorrect deliveries from the seller

If MINT LAMA GmbH makes an incorrect delivery of a product, the return postage will be refunded to the customer. If the goods are returned correctly, no further costs that may have been incurred will be reimbursed.

Best price guarantee

MINT LAMA GmbH grants a best price guarantee. This applies to the identical product in stock from the MINT LAMA brand offered by a Swiss retailer on the same day (in CHF). For this, MINT LAMA GmbH requires an e-mail with the link to the corresponding offer. If the offer has been checked and everything is correct, the more favorable offer will be confirmed to the customer via order confirmation. The amount can then be paid and the customer receives the product from MINT LAMA GmbH. Payment must be made within 7 days.

The best price guarantee does not apply to private sales, auction platforms, bankruptcy sales and other non-regular sales channels. The best price guarantee only applies to stores within Switzerland. Promotional vouchers cannot be redeemed for the best price guarantee.

MINT LAMA GmbH reserves the right not to grant a best price guarantee in conjunction with the 3-year guarantee. Should this be the case, the customer will be informed accordingly.

Warranty and liability

In general, all products offered by MINT LAMA GmbH have a warranty period of 24 months from the date of order. When purchasing MINT LAMA products from dealers, complaints / warranty claims must be made directly with the dealer. For orders placed directly from the homepage (mintlama.ch), the warranty period is 24 + 12 months for MINT LAMA brand products (third-party brands are excluded). In the event of a complaint / warranty claim, the manufacturer or importer will decide whether or not it is a warranty case. If the defects in the goods are the fault of the customer, for example in the case of careless handling, attempted repairs or incorrect assembly, the warranty can be rejected. In the case of second-hand or sale items, a guarantee is excluded or subject to written agreement.

In the event of product defects, the seller grants the customer the right to exchange the goods. The customer returns the goods at his own expense and with prior notification in writing to MINT LAMA GmbH by e-mail.

In addition, the sellers, distributors and suppliers of MINT LAMA GmbH products reject any liability that may arise from negligent or incorrect use, such as damage, injury, death or similar. 

Repairs

During repair work on MINT LAMA products authorized by the customer, certain alterations may be permanently visible. These changes (e.g. scars, PVC patches, etc.) are of an aesthetic nature only, without affecting the functionality of the product.

Terms of payment

For orders in the online store of MINT LAMA GmbH, the prices listed in the offer at the time of the order apply. The prices quoted are final prices, i.e. they include the applicable statutory value added tax. All prices are in Swiss francs. Various payment options are available to the customer, which are indicated in the seller's online store:

1. advance payment. Transfer to the seller's bank account. Bank details can be found on the order confirmation / invoice.
2. twint. The customer is redirected to Twint to make the payment.
3. credit/debit card. The customer is redirected to Payrexx to make the payment via their credit or debit card.
4. PayPal. The customer is redirected to their PayPal account to make the payment. When paying via PayPal, additional commissions are charged, 2% of which must be paid by the customer.

The ordered goods will always be sent after the payment has been booked. In the case of bank transfer, the amount should be paid within a maximum of 30 days. After this period, MINT LAMA GmbH reserves the right to cancel the order.

In exceptional cases, the goods can be purchased on account. This option or other payment modalities can be agreed separately between the seller and the customer. The payment period is generally 10 days from receipt of the invoice by the customer. If payment is not made within 10 days of the due date, the customer is in default and will be sent a reminder by e-mail. In the event of default, the customer may incur a processing fee of CHF 100 in addition to the invoice amount.

Deadlines

If working days are specified as deadlines, this means all weekdays with the exception of Saturdays, Sundays and public holidays.

Data protection

So that the delivery can be carried out according to your instructions, we pass on the name and address you provide to our logistics partners. MINT LAMA GmbH ensures that all necessary measures are taken in accordance with the Data Protection Act (DSG) to guarantee the security and confidentiality of your personal data. This transfer takes place as part of our obligation to deliver your goods to you quickly and securely. Your personal data will not be passed on to third parties for any other purpose.

Right to information

In accordance with the Data Protection Act (DSG), individuals have the right to request information from the controller, in this case MINT LAMA GmbH, as to whether their personal data is being processed. These individuals may also request the deletion or correction of their data. The right of access enables customers to check the data collected about them and to assert their rights in accordance with the FADP. It also ensures transparency with regard to data processing. It is the responsibility of each person to take action themselves to exercise this right.
When exercising the right of access under the DPA, certain information must be provided in accordance with the law. This includes the identity and contact details of the controller, information about the personal data processed, the purpose of processing, the retention period, the origin of the data and information about recipients or categories of recipients, particularly abroad.
Persons exercising their right of access do not have to justify their requests. As a rule, information and deletion will be provided free of charge within 30 days.

Duty to provide information in accordance with the Data Protection Act

MINT LAMA GmbH, as the data controller, is obliged to provide transparent information about the procurement and processing of personal data in order to ensure transparent data processing and to strengthen the rights of the data subjects. This includes providing information on the identity and contact details of the controller, the purpose of processing and, where applicable, recipients of personal data.
The obligation to provide information applies to any planned data collection or processing, regardless of whether the data originates directly from the data subject. MINT LAMA GmbH must ensure that this information is provided in a concise, transparent, comprehensible and easily accessible form.  
Exceptions to the obligation to provide information may exist in certain cases in accordance with Article 20 FADP, for example if the data subject already has the information or the processing is provided for by law. Companies must review and update their data protection declarations accordingly.
